Terms of Service

By accessing and using Stoke, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

Stoke is an AI-powered romantic assistant that provides personalized suggestions for romantic gestures, date ideas, and relationship planning. The service uses artificial intelligence to generate customized recommendations based on your preferences.

• You must be at least 18 years old to use this service
• You are responsible for maintaining the confidentiality of your account
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use

• Premium subscriptions are billed monthly or yearly
• Payments are processed securely through Stripe
• Subscriptions automatically renew unless canceled
• Refunds are provided according to our refund policy
• We reserve the right to change pricing with 30 days notice

Stoke offers auto-renewable subscription options:

• Stoke Premium Monthly: $14.99/month
• Stoke Premium Yearly: $129.99/year

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscriptions by going to your App Store account settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Subscription prices displayed in United States Dollars (USD) are representative base pricing. Actual prices charged to subscribers may vary based on the following factors:

• Local Currency Conversion: Prices are automatically converted to your local currency by the applicable payment platform (Apple App Store or Stripe) based on current exchange rates, platform-specific pricing tiers, and regional adjustments. The Company does not control these conversions or regional pricing policies.
• Payment Platform Fees: Subscriptions purchased through the Apple App Store may be priced differently than subscriptions purchased directly through our website or mobile web platform via Stripe, due to platform-specific processing fees, regional pricing requirements, and distribution costs imposed by the respective payment processors.
• Tax and Regulatory Charges: Applicable sales tax, value-added tax (VAT), goods and services tax (GST), or other mandatory charges may be added to your subscription price based on your jurisdiction. Such charges are determined by local law and collected by the payment platform.
• Promotional Pricing: Introductory offers, discounts, or promotional pricing may be available in certain regions or through specific payment platforms and are subject to eligibility requirements and time limitations as determined by the Company.

By subscribing to the Service, you acknowledge that the final amount charged to your payment method may differ from the base USD pricing displayed, and you agree to pay all applicable fees, including currency conversion charges and local taxes, as determined by your payment platform and jurisdiction.

The Company reserves the right to adjust subscription pricing at any time with advance notice as required by applicable law or payment platform policies. Existing subscribers will be notified of price changes in accordance with Section 4 (Subscription and Payment) of these Terms.

For users who download and use the Stoke application through the Apple App Store, your use of the application is governed by Apple's Standard End User License Agreement (EULA), which is incorporated herein by reference.

In the event of any conflict between Apple's Standard EULA and these Terms of Service, Apple's Standard EULA shall govern with respect to your use of the iOS application.

Key provisions include:

• Scope of License: Apple grants you a limited, non-transferable license to use the application on iOS devices that you own or control.
• Maintenance and Support: The Company (Stoke), not Apple, is solely responsible for providing maintenance and support services for the application.
• Warranty: The Company is responsible for product warranties to the extent not effectively disclaimed. Apple has no warranty obligation with respect to the application.
• Product Claims: The Company, not Apple, is responsible for addressing any claims relating to the application or your possession and use of it, including product liability claims, consumer protection claims, and intellectual property infringement claims.
• Third Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS application, and Apple has the right to enforce these Terms against you.

By downloading or using the Stoke application from the Apple App Store, you acknowledge that you have read, understood, and agree to be bound by Apple's Standard EULA in addition to these Terms of Service.

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Transmit harmful code or malware
• Attempt to gain unauthorized access to our systems
• Use the service to harass or harm others
• Share your account with others

Our AI assistant provides suggestions and ideas for informational purposes only. We do not guarantee the accuracy, suitability, or success of any recommendations. You are responsible for evaluating and implementing suggestions at your own discretion.

All content, features, and functionality of the service are owned by Stoke and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service.

Your use of the service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason. You may cancel your account at any time through your account settings.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

We may modify these terms at any time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

These terms are governed by the laws of the jurisdiction in which we operate. Disputes will be resolved in the courts of that jurisdiction.
